    WARNING to all, including myself.

    The law is has been in effect in case you didn't know.

    CAN-SPAM Act is now Federal Law

    The new CAN-SPAM Act is in effect, and it's changing the face of e-mail
    marketing. If you're using e-mail to keep in touch with customers or
    prospects, you need to understand how this new legislation will impact you.
    For example, all "commercial" messages must now ...
    a.. Include a valid e-mail return address
    b.. Have a relevant subject line
    c.. Include a postal address
    d.. Offer the ability to unsubscribe & have the request processed within
    10 days
    We've included a link to the new CAN-SPAM Act of 2003, along with a couple
    of interpretations, to help you understand the new law. Be sure to review
    them before you send out your next e-mail!

    Big deal. Anyone noticed how well it's "working"? If anything, the SPAM in
    my inbox has increased since the Act's inception.

    I agree...I just got 252 new emails in my inbox within the last 10
    minutes...most I've ever gotten in one day is about 5. But I have no idea
    what lead up to that.

    There is a difference between a computer doing it, and you.

    I'm not saying that you personally are doing it, but some one else in this
    group may take the liberty, and drop you an email.

    Like any previous law, it's only a matter of time before someone files a
    lawsuit. Then people think twice about what they're doing.

    California has a No-call law that went into effect not long ago. There are
    now several lawsuits filed and won. Some have received 1,000,000.00 damages
    for there negligence. Others have now disappeared and hiding from the law
    for sending unsolicited FAXES.

    It's only a matter of time before someone files one against anyone of us
    that do marketing via email that live in the US and it is a big deal for
    legitimate businesses.

    This isn't to mention you can't send an email for your company marketing.
    There are several procedures that you must follow, and accept for doing this
    time of marketing.

    Non-compliance will cost you in the end.

    One of the biggest problems for maintaining a business afloat, has to do
    with LEGAL ISSUES, and not so much to do with your product. People who don't
    take it seriously will cost them sooner or later. You must know the LAW and
    respect it to be a legitimate business.

    The casual email is not what's intended to be regulated. What *is* intended
    are *mass* emailings to lists of addresses that are bought and sold all over
    the world.

    The best the new Act can do is to keep the honest people honest. The only
    way the law can be enforced, is if violators comply, and include all of the
    required information, so that recipients can complain. The rest will
    continue to ignore the law, and therefore, the law is simply unenforceable.
    It's Congressional arrogance and stupidity at its usual level. In any case,
    it's a U.S. law, while the Internet is a world-wide entity. How could
    Congress be so naive as to expect to control the flow of SPAM from the vast
    numbers of sources that lie outside of the U.S.?

  10. If this is a U.S. Act it still won't stop people from
    countries outside the U.S. spamming their heads off.

    This is a problem that just won't go away.

    Then simply apply it to yourself, if you live in the USA.

    I posted it for those who deal in the USA and try to run and will be running
    a responsible business.
